Use TIRO360 lawfully, protect worker and client information, review reported attendance and work evidence, and keep authorised people responsible for operational and employment decisions.
1. Agreement and provider
These Terms of Service form an agreement between you and Zandile William Fanqa, the South African operator of TIRO360. By creating an account, accessing an organisation workspace, or using TIRO360’s services, you agree to these terms and the Privacy Policy. If you use TIRO360 for an organisation, you confirm that you are authorised to accept these terms for that organisation.
If you do not agree, do not use the service.
2. What TIRO360 provides
TIRO360 supports field operations through job dispatch, site and team management, shift planning, attendance reporting and review, work evidence, incident reporting and client service tools. Available features depend on the account, permissions, device and connectivity.
Features may change as the service develops. Any paid plan, quotation, order form, or organisation agreement may include additional commercial terms. If an additional term conflicts with these terms, the specifically agreed commercial term applies to that conflict.
3. Accounts and authorised users
- You must provide accurate account and organisation information.
- You are responsible for activity under your account and for keeping credentials confidential.
- Each person must use their own authorised access unless TIRO360 expressly permits another arrangement.
- You must promptly remove access for team members who leave or no longer require it.
- You must notify TIRO360 promptly if you suspect unauthorised access or a security incident.
TIRO360 may suspend access reasonably believed to be compromised, unlawful, abusive, or a threat to the service or other users.
4. Organisation responsibilities
An organisation using TIRO360 is responsible for:
- the accuracy, lawfulness, and quality of information entered into its workspace;
- providing required privacy notices and having a lawful basis for worker location processing, attendance records and client communications;
- honouring opt-outs and complying with POPIA rules for electronic direct marketing;
- configuring organisation access and limiting staff permissions appropriately;
- reviewing AI-assisted responses and correcting errors when needed;
- checking site assignments, shift times, attendance reports and work evidence before relying on them;
- making final attendance, employment, safety and client-service decisions through authorised people; and
- complying with employment, workplace safety, privacy and other laws applicable to its operations.
5. Acceptable use
You may not use TIRO360 to:
- break the law, infringe rights, deceive, harass, discriminate, or send unlawful spam;
- collect or disclose personal information without proper authority;
- make unlawful or solely automated decisions that significantly affect a person;
- upload malware, probe security, bypass access controls, or disrupt the service;
- reverse engineer or copy protected parts of the service except where law expressly permits;
- misrepresent AI-generated content as verified professional, financial, or legal advice; or
- use the platform for a purpose materially unrelated to legitimate field-work operations.
6. AI-assisted content
AI can produce incomplete, inaccurate, outdated, or unsuitable content. TIRO360 assists people; it does not replace professional judgment. Organisation users must check important responses and records before acting on them.
Planned shifts, GPS readings and offline reports do not independently prove attendance, identity or completed work. Authorised reviewers must assess the evidence. TIRO360 does not replace workplace safety procedures or emergency services, and attendance records alone do not determine payroll entitlement.
7. Customer content and permissions
You retain ownership of content that you lawfully upload or submit. You grant TIRO360 a limited right to host, process, transmit, reproduce, and display that content only as reasonably necessary to provide, secure, support, and improve the service and meet legal obligations.
You confirm that you have the rights and permissions needed for content you submit. You must not upload confidential or sensitive information unless it is necessary, authorised, and handled through an appropriate process.
8. Privacy and data protection
Each party must comply with applicable privacy law. When TIRO360 processes organisation worker, customer and field-work information on the organisation’s instructions, the organisation generally acts as the responsible party and TIRO360 as its operator. The organisation must provide lawful, documented instructions and maintain appropriate notices and permissions.
Details about TIRO360’s processing are in the Privacy Policy. Deletion requests are explained in the Data Deletion Instructions.
9. Third-party services
TIRO360 may depend on third-party services such as device location services, cloud hosting, authentication, email delivery, and AI providers. Their availability and independent terms may affect TIRO360. You are responsible for accounts, permissions, fees, and compliance required by third-party services you connect.
10. Fees and subscriptions
Fees, billing periods, taxes, plan limits, and renewal or cancellation arrangements will be stated in the plan, quotation, order form, or organisation agreement accepted by the customer. Unless that document states otherwise, fees already earned for a supplied period are not refundable except where required by law.
11. Availability and changes
We aim to provide a reliable service, but TIRO360 is supplied on an “as available” basis. Maintenance, faults, internet issues, third-party outages, security events, or circumstances outside reasonable control may interrupt access. We may change, limit, or discontinue a feature where reasonably necessary and will try to give suitable notice of material changes.
12. TIRO360 intellectual property
TIRO360’s software, design, branding, documentation, and platform content are protected by intellectual property law. Except for the limited right to use the service under these terms, no ownership right is transferred to you. “TIRO360” and related branding may not be used in a misleading or unauthorised way.
13. Suspension and termination
You may stop using TIRO360 and may request account closure subject to any agreed subscription terms. TIRO360 may suspend or terminate access for material breach, non-payment under an applicable commercial agreement, security risk, unlawful use, or where continuing the service is not reasonably possible.
On termination, access may end and data will be handled according to the Privacy Policy, organisation instructions, applicable agreements, and legal retention duties. Provisions that logically need to continue after termination will survive.
14. Important disclaimers
To the extent permitted by law, TIRO360 does not guarantee that the service or AI-assisted content will always be error-free, uninterrupted or suitable for every field-work process. Location accuracy, device permissions, connectivity and delayed offline syncing can affect records. Check important operational information before acting on it.
Nothing in these terms excludes a right or remedy that cannot lawfully be excluded.
15. Liability
To the extent permitted by law, neither party will be liable to the other for indirect, incidental, special, or consequential loss, or for lost profits or business opportunities, arising from the service. Any further liability limits in an accepted quotation, order form, or organisation agreement will also apply.
These limits do not apply where liability cannot lawfully be limited, including liability arising from fraud, wilful misconduct, or other circumstances for which exclusion is prohibited.
16. Governing law
These terms are governed by the laws of the Republic of South Africa. The parties should first try in good faith to resolve a dispute directly. Nothing prevents either party from using a court, regulator, or other remedy available under applicable law.
17. Changes to these terms
We may update these terms as TIRO360 develops or legal requirements change. The updated version will be posted here with a revised date. Where reasonably practicable, material changes affecting active customers will also be communicated through the service or by email.
